3. DEFINITIONS

“Booking” means a confirmed reservation or travel arrangement made through Travel Diaries India.
“Booking Confirmation” means the written confirmation issued by Travel Diaries India or the relevant
Supplier confirming a Booking.
“Supplier” means any airline, hotel, railway operator, cruise operator, transportation provider,
insurance company, visa service provider, tour operator, destination-management company, activity
provider or other third party supplying a component of a travel arrangement.
“Services” means the travel-related services offered, arranged, facilitated or sold through Travel Diaries
India.
“Website Content” means all text, photographs, videos, graphics, designs, logos, trademarks,
itineraries, travel descriptions, articles, databases, software, layouts and other material appearing on
the Website.
4. ACCEPTANCE OF TERMS
Your use of the Website or purchase of Services constitutes your acceptance of these Terms.
If you make a Booking on behalf of another person or persons, you represent that you have authority to
make the Booking on their behalf, have informed them of these Terms, have obtained any necessary
consent to provide their information, and accept responsibility for ensuring that all information supplied
to us is accurate and complete.
5. CHANGES TO THESE TERMS
Travel Diaries India may amend, update or replace these Terms from time to time. The latest version
will be published on the Website together with the applicable “Last Updated” date.
Changes will generally apply prospectively. For an existing Booking, the Terms and specific Booking
conditions applicable at the time of confirmation will generally continue to govern that Booking, subject
to applicable law.
6. TRAVEL DIARIES INDIA'S ROLE
Travel Diaries India may act as a travel organiser, booking agent, intermediary, facilitator or service
provider, depending upon the particular Service.
Many travel arrangements involve independent Suppliers. Unless expressly stated otherwise in writing,
Travel Diaries India does not own, operate or control every airline, hotel, vehicle, cruise, attraction,
activity or other service included in an itinerary.
The services supplied by third parties may therefore be subject to their own terms, conditions,
restrictions, cancellation policies and operating procedures.
7. WEBSITE INFORMATION
We make reasonable efforts to ensure that information published on the Website is accurate and useful.
However, travel information can change rapidly.
Prices, schedules, hotel facilities, photographs, room categories, transport arrangements, attractions,
routes, operating hours, itineraries and other information may change without notice because of
availability, operational requirements, weather, government restrictions, Supplier decisions or other
circumstances.

Website photographs are generally intended to provide a representative impression and may not
necessarily depict the exact room, vehicle, seat, vessel or facility allocated to you.
A statement appearing on the Website should not be interpreted as an unconditional guarantee unless
Travel Diaries India expressly confirms that guarantee in writing.
8. TRAVEL QUOTATIONS
A quotation, itinerary or price estimate provided by Travel Diaries India is not necessarily a confirmed
Booking.
Unless expressly stated otherwise, quotations are subject to availability, Supplier confirmation,
applicable taxes and charges, the validity period specified in the quotation, and the terms and
conditions applicable to the relevant Supplier.
A quotation may change before confirmation due to changes in availability, Supplier rates, taxes,
government charges, currency exchange rates, fuel costs or other factors.
The final price and inclusions will be those stated in the applicable Booking Confirmation, invoice or
other written confirmation.
9. BOOKING CONFIRMATION
A Booking shall generally be considered confirmed only after the required customer information has
been received, the required payment or deposit has been received, the relevant Supplier has confirmed
availability, and Travel Diaries India has issued written confirmation.
An enquiry, telephone conversation, WhatsApp message, email request or provisional reservation does
not automatically constitute a confirmed Booking.
Travel Diaries India may decline or cancel a request where the requested Service is unavailable,
required information is incomplete, payment is not received within the specified time, the Supplier
refuses confirmation, there is a suspected fraudulent transaction, or circumstances make fulfilment
commercially or operationally impracticable.
Where an amount is refundable in such circumstances, it will be handled in accordance with the
applicable Booking conditions and law.
10. CUSTOMER RESPONSIBILITY FOR BOOKING INFORMATION
You are responsible for checking all Booking details immediately after receiving your confirmation,
including passenger names, dates of birth, travel dates, destinations, passport numbers, nationality,
flight details, hotel dates, room category, number of travellers, meal requirements, transportation
details and other personal or travel information.
Names should be supplied exactly as they appear on the relevant travel document.
Travel Diaries India shall not be responsible for additional costs resulting from incorrect, incomplete or
late information supplied by the Customer, except where liability cannot lawfully be excluded.
11. PAYMENT TERMS
Payments must be made using the payment method and within the time specified by Travel Diaries
India.
Depending upon the Service, payment may be required in full at the time of Booking, as a deposit
followed by one or more instalments, or according to a payment schedule specified in the quotation or
Booking Confirmation.
Failure to pay within the specified period may result in cancellation of the Booking, loss of availability,
price changes or applicable cancellation charges.

Travel Diaries India reserves the right not to hold an itinerary or reservation unless the required
payment has been received.
12. PAYMENT PROCESSING
Where online payments are accepted, payment processing may be handled by third-party payment
gateways or financial institutions.
Travel Diaries India does not ordinarily receive or store full payment-card credentials where such
information is processed directly by an authorised payment provider.
The relevant payment provider may apply its own terms and privacy practices.
You agree not to make fraudulent payment claims, unauthorised chargebacks or false payment
disputes. Nothing in this clause limits your lawful rights regarding an unauthorised transaction or
genuine payment dispute.
13. PRICES, TAXES AND SURCHARGES
Unless expressly stated otherwise, quoted prices may be subject to GST or other applicable taxes,
airport taxes, fuel surcharges, visa fees, tourism or destination taxes, hotel taxes, government charges,
entrance fees, service charges, currency fluctuations, Supplier-imposed surcharges and other
mandatory charges.
The applicable Booking Confirmation or invoice will specify the charges included and excluded from the
price.
14. CANCELLATION BY THE CUSTOMER
A Customer may request cancellation of a Booking by contacting Travel Diaries India through the official
contact details provided with the Booking. Cancellation is effective only when acknowledged or
processed by Travel Diaries India.
Cancellation charges will depend upon the type of Service, date of cancellation, Supplier cancellation
policy, whether the booking is refundable, amount already paid to Suppliers, applicable
airline/hotel/tour operator rules, and any cancellation conditions communicated to the Customer before
or at the time of Booking.
Some travel products may be completely non-refundable.
15. REFUND POLICY
Where a refund is legally or contractually due, Travel Diaries India will process the eligible amount in
accordance with the applicable Booking conditions.
Refund calculations may take into account Supplier cancellation charges, non-refundable components,
fare restrictions, hotel cancellation charges, visa charges, payment gateway charges where lawfully
non-refundable, Travel Diaries India service or processing charges where clearly disclosed and legally
permissible, and other amounts expressly identified in the Booking conditions.
A refund from a Supplier may need to be received by Travel Diaries India before the corresponding
amount can be passed to the Customer. Accordingly, refund processing times may vary.
Unless otherwise required by law, a Customer is not entitled to a refund merely because a Service was
not used after the Customer voluntarily chose not to travel.
16. CANCELLATION BY TRAVEL DIARIES INDIA
Travel Diaries India may cancel or modify a Booking where reasonably necessary because of Supplier
cancellation, non-payment, fraud or suspected fraudulent activity, incorrect information, force majeure,

government restrictions, safety concerns, material operational changes, or circumstances beyond our
reasonable control.
Where Travel Diaries India cancels a confirmed Booking for reasons within our responsibility and a
refund is legally due, the applicable refund will be handled in accordance with the Booking terms and
applicable law.
Where cancellation results from a Supplier or force-majeure event, the Customer's remedy may depend
upon the refund or alternative arrangements actually available from the relevant Supplier, subject
always to applicable law.
17. CHANGES TO A BOOKING
Requests to change a Booking are subject to availability and Supplier approval. Changes may include
travel dates, passenger details, hotel, room category, transportation, destination, sightseeing, flights,
railway tickets or other itinerary components.
A change may result in additional charges, fare differences, amendment fees, cancellation charges or
other Supplier-imposed costs.
No change is effective until confirmed in writing.
18. AIRLINE BOOKINGS
Airline tickets are subject to the applicable airline's fare rules and conditions.
Travel Diaries India does not control flight delays, cancellations, rescheduling, denied boarding,
overbooking, seat allocation, baggage rules, aircraft changes, airport restrictions, airline operational
decisions or other carrier-related matters.
Where an airline changes or cancels a flight, Travel Diaries India may assist the Customer in
communicating with the airline, but the ultimate remedy may be determined by the airline's rules and
applicable law.
19. RAILWAY BOOKINGS
Railway bookings are subject to the rules, availability, cancellation policies and operating procedures of
the relevant railway authority or booking provider.
Travel Diaries India does not guarantee confirmation of a requested railway reservation until written
confirmation has been issued.
20. HOTEL BOOKINGS
Hotel reservations are subject to the hotel's availability and policies.
Hotel facilities, room layouts, meal arrangements, check-in/check-out times and amenities may vary.
Hotels may separately charge for security deposits, local taxes, resort fees, tourism charges, additional
guests, meals not included in the Booking, room upgrades, early check-in, late check-out, minibar usage
and other optional or incidental services.
Unless expressly included in your Booking Confirmation, such charges are the Customer's responsibility.
21. TRANSPORTATION
Transportation services may be provided by independent transport operators.
Vehicle type, driver, route, timing, seating capacity and other details may be subject to operational
changes.
Customers must comply with reasonable safety instructions issued by the transport provider.

Travel Diaries India shall not be responsible for losses caused by a transport provider's independent
acts or omissions except to the extent that such liability is imposed on Travel Diaries India by applicable
law.
22. VISA, PASSPORT AND IMMIGRATION REQUIREMENTS
Customers are responsible for obtaining valid passports, visas, permits, entry approvals and other
documents required for their journey.
Where Travel Diaries India provides visa or documentation assistance, we act only as an
assistance/facilitation service unless expressly agreed otherwise.
Visa approval is solely determined by the relevant embassy, consulate, immigration authority or
government department.
Travel Diaries India does not guarantee visa approval, visa processing time, entry permission,
immigration clearance, boarding permission or acceptance of any particular travel document.
Visa fees and government charges may be non-refundable.
23. TRAVEL INSURANCE
Travel insurance is recommended for appropriate travel arrangements.
Where Travel Diaries India assists with the purchase of travel insurance, the insurance policy is
provided by the relevant insurer.
Claims are governed by the insurer's policy terms, exclusions, conditions and procedures.
Travel Diaries India does not guarantee acceptance or payment of an insurance claim.
24. HEALTH AND TRAVEL FITNESS
Customers are responsible for determining whether they are medically and otherwise fit to undertake
their chosen travel arrangements.
Customers should obtain appropriate professional advice where necessary and ensure that they have
suitable travel insurance.
Certain destinations or activities may involve risks associated with altitude, weather, wildlife, water,
transportation, adventure activities or other conditions.
Customers participate in activities at their own responsibility, subject to the rights and protections
available under applicable law.
25. CHILDREN AND MINORS
Where a minor travels under a Booking, the parent, legal guardian or responsible adult making the
Booking is responsible for ensuring that the minor has all required documentation and complies with
applicable travel requirements.
Certain airlines, hotels, destinations and activities may impose additional age restrictions or
documentation requirements.
26. FORCE MAJEURE
Travel Diaries India shall not be responsible for delay, alteration, suspension or failure to provide a
Service to the extent caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, floods, earthquakes, severe weather, pandemics or
epidemics, war, terrorism, civil disturbance, strikes, industrial action, government restrictions, border
closures, political instability, airport disruption, railway disruption, Supplier failure, technical failures,

public-health emergencies, changes in immigration rules, or other extraordinary circumstances beyond
our reasonable control.
Where reasonably possible, Travel Diaries India will endeavour to assist Customers with alternative
arrangements.
27. THIRD-PARTY SUPPLIERS
Travel Diaries India may use or arrange services supplied by third parties.
Such Suppliers operate independently and may impose their own terms, booking conditions,
cancellation policies, refund rules, safety requirements and eligibility requirements.
The Customer agrees to comply with applicable Supplier conditions.
Nothing in these Terms is intended to exclude liability that Travel Diaries India is legally required to
accept.
28. WEBSITE AVAILABILITY
We endeavour to keep the Website available and secure but do not guarantee that it will always be
uninterrupted, error-free, completely secure, free of viruses or harmful components, or continuously
available.
The Website may be temporarily unavailable due to maintenance, upgrades, technical failures, hosting
problems, cybersecurity incidents or other circumstances.
29. PROHIBITED WEBSITE USE
You must not: use the Website for an unlawful purpose; provide false or misleading information;
impersonate another person; attempt to obtain unauthorised access to our systems; interfere with
Website security or operation; introduce malicious code; use automated systems to excessively scrape

changes to travel schedules, or events arising from the Customer's own acts or omissions.
However, nothing in these Terms excludes or limits liability that cannot legally be excluded or limited
under applicable law, including liability arising from matters for which the law provides mandatory
consumer protection.
Where Travel Diaries India is legally responsible for a direct loss, its liability shall be determined in
accordance with applicable law and the circumstances of the claim.
40. CUSTOMER INDEMNITY
To the extent permitted by law, you agree to indemnify and hold harmless Travel Diaries India, its
officers, employees, representatives and authorised service partners against losses, claims, liabilities
and reasonable costs arising from your material breach of these Terms; fraudulent or unlawful use of
the Website; inaccurate information supplied by you; your infringement of another person's
intellectual-property rights; your misuse of the Website; your unlawful conduct; or your violation of
applicable Supplier rules.
This indemnity does not apply to the extent that a claim arises from Travel Diaries India's own unlawful
conduct or liability that cannot legally be transferred to the Customer.
41. CONSUMER PROTECTION
Travel Diaries India respects the rights and protections available to consumers under applicable Indian
law.
Nothing in these Terms is intended to exclude a mandatory statutory right, prevent a Customer from
exercising a lawful consumer remedy, restrict a competent consumer authority's jurisdiction, or
contract out of a legal protection that cannot lawfully be waived.
Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory
legal provision shall prevail to the extent of the conflict.
42. COMPLIANCE WITH INDIAN LAW
These Terms are intended to operate consistently with applicable laws of India, including, where
applicable, the Indian Contract Act, 1872; Copyright Act, 1957; Trade Marks Act, 1999; Consumer
Protection Act, 2019; applicable Consumer Protection (E-Commerce) Rules; applicable taxation and GST
laws; applicable information-technology and cybersecurity requirements; applicable data-protection
and privacy legislation; and other laws and regulations applicable to the relevant Service.

the Service.
43. DISPUTE RESOLUTION
If you have a complaint or dispute concerning a Service, please contact Travel Diaries India first and
provide the Booking/reference number, Customer name, date of Booking, nature of the complaint and
relevant supporting documents.
We will make reasonable efforts to investigate and resolve genuine complaints.
Where a dispute cannot be resolved through communication, the Customer may pursue any remedy
available under applicable law, including before an appropriate consumer dispute redressal commission
or other competent authority.
44. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of India.
Nothing in this clause prevents a consumer from exercising a mandatory right or remedy available
under applicable Indian law.
45. JURISDICTION
Subject to applicable consumer-protection laws and mandatory jurisdictional rules, disputes arising

If Travel Diaries India does not immediately enforce a provision of these Terms, that does not mean that
we have waived our right to enforce the provision later.
48. ASSIGNMENT
Travel Diaries India may assign or transfer its rights or obligations under these Terms where permitted
by law.
Customers may not transfer their rights or obligations under these Terms without our prior written
consent, except where such restriction is prohibited by applicable law.
49. ENTIRE AGREEMENT
These Terms, together with the applicable quotation, Booking Confirmation, invoice, cancellation policy,
Supplier conditions, Privacy Policy and any other terms expressly incorporated into the Booking,
constitute the agreement governing the relevant Service.
Where a specific Booking condition conflicts with a general provision of these Terms, the specific
Booking condition shall generally apply to that Booking to the extent of the conflict, subject to
applicable law.

50. ELECTRONIC COMMUNICATIONS
You consent to receiving Booking-related communications electronically through email, SMS, telephone,
messaging services or other communication methods provided by you.
Electronic records may be used to document enquiries, quotations, confirmations, amendments,
cancellations and other communications, subject to applicable law.
